Terms of Service

The agreement between Gamecart and the sellers who run their stores on it: what we provide, how payments flow, what you are responsible for, and how plans, billing and cancellation work.

1. About Gamecart

Gamecart ("Gamecart", "we" or "us") operates the Gamecart platform, including the dashboard, the stores hosted on it, the public API, webhooks, plugins, themes and every other part of the service (together, the "Service"). These Terms of Service (the "Terms") are the agreement between Gamecart and you, the person or organization that uses the Service to run a store ("you" or the "seller").

2. Accepting these Terms

The agreement is formed when you create an account and accept these Terms at sign-up. We record the version you accepted, the date and the IP address used. The Acceptable Use Policy and the Data Processing Addendum are part of these Terms. The Privacy Policy explains how we handle personal data.

You must be at least 18 years old, or the age of legal capacity where you live, to create an account. If you use the Service on behalf of a company or another organization, you confirm that you are authorized to bind it, and "you" refers to that organization.

3. What Gamecart provides

Gamecart lets game server owners build online stores, sell digital products and deliver them to their players ("buyers"), for example by running commands on a game server or granting Discord roles. The Service also includes the tools to manage those stores, such as catalog, orders, team management, themes, integrations and an API.

4. Payments between buyers and sellers

Gamecart is not the seller of any product listed in a store and is not a merchant of record. The contract of sale is between the buyer and the seller.

  • Buyers pay the seller directly, through the payment providers the seller connects to the store.
  • Gamecart never receives, holds or transfers the money paid for a store's products and is not a payment institution or financial intermediary.
  • Provider fees, payout schedules, holds, reserves, account reviews, disputes and chargebacks are matters between the seller and its payment provider, under that provider's terms.
  • The only amounts Gamecart charges are the subscription prices of its plans, described below.

5. Your account and security

You must provide accurate information and keep it up to date. You are responsible for all activity under your account, including actions taken by team members you invite and by the keys, tokens and integrations you create.

  • Keep your password, verification codes, keys and tokens confidential, and revoke the ones you no longer use.
  • Give team members only the permissions they need; they act on your behalf.
  • Tell us at support@gamecart.gg as soon as you suspect unauthorized access.

We may ask you for information or documents that confirm your identity or the identity of the organization you represent, for example when a store is reported or when the law or a payment provider requires it. If you do not provide them within a reasonable time, we may restrict or suspend the account.

6. Your responsibilities as a seller

You are solely responsible for your store and for everything you sell through it, including:

  • the products, their descriptions and prices, and delivering what you sell as described;
  • support to your buyers, refunds, disputes and chargebacks with your payment providers;
  • taxes, invoices and any tax or consumer obligation that applies to your sales;
  • your own store terms and privacy notice for your buyers, and the lawful handling of their data as controller;
  • complying with the terms, EULAs and commercial usage rules of the games and platforms your store relates to, such as Minecraft (Mojang), FiveM (Cfx.re) or Hytale.

Gamecart does not provide support to your buyers about their orders, and directs buyers who contact us to you. Templates we provide, such as default store terms and email texts, are a starting point and not legal advice; you are responsible for adapting them to your store and to the law that applies to it.

You must also follow the Acceptable Use Policy, which lists what cannot be sold or done with the Service. Gamecart does not review stores in advance. If a rights holder, a platform or a buyer reports that a store breaks these rules, we may act as described in Suspension and termination.

7. Minors and child protection

Stores on Gamecart are likely to be accessed by children and adolescents. As the provider of your store and of the game or server it relates to, you are responsible for complying with the laws that protect minors where your buyers are, such as Brazil's Digital Statute of Children and Adolescents. In particular, you must:

  • not sell loot boxes or other paid products with a random or chance-based reward, as described in the Acceptable Use Policy;
  • obtain any consent from a parent or legal guardian that the law requires before processing data of a buyer who is a child;
  • not use your store, or scripts, pixels or trackers you add to it, to profile minors for advertising.

Gamecart may remove products, restrict features or suspend a store that it reasonably believes breaches this section, without prior notice when the protection of minors requires it.

8. Plans, trial and billing

Each store has its own plan. The available plans, with their prices, features and limits, are shown on the pricing page and in the dashboard.

  • The first subscription of an account may include a free trial, whose length is shown before you subscribe. A payment method is required, and billing starts when the trial ends unless you cancel before.
  • Subscriptions renew automatically at the end of each billing period until cancelled. Prices may vary by region and are charged through our billing provider.
  • If you switch from one subscription plan to another, the change takes effect immediately and is prorated; any resulting credit applies to future invoices.
  • We may change plan prices. A new price applies from your next billing period after we notify you, and you may cancel before it applies.

9. Cancellation, refunds and downgrades

  • You can cancel anytime in the dashboard. Your plan remains active until the end of the current billing period (or trial), then the store moves to the free plan.
  • Payments are non-refundable except where required by law. Where the law gives you a right to withdraw from a purchase within a set period, you can exercise it by writing to us.
  • A downgrade you request is accepted only while the store fits the limits of the target plan.
  • When a store moves to the free plan, resources above its limits are kept, but new ones can't be created until the store fits those limits or upgrades again.

10. Fair use and technical limits

Features advertised as unlimited are still subject to technical limits of reasonable use that protect the Service for every seller, such as limits on request rates, file sizes and the number of certain resources. If your use degrades the Service or goes far beyond normal use, we may limit it. When reasonably possible, we will contact you first so you can adjust your use.

11. Your content

You keep all rights to the content you upload or create in the Service, such as products, images, theme customizations, pages and emails. You grant Gamecart a worldwide, non-exclusive, royalty-free license to host, copy, process and display that content only as needed to operate, secure and improve the Service.

You confirm that you have the rights needed for that content. Gamecart may remove content that breaks these Terms or the law. When you use a custom domain, you are responsible for owning or being authorized to use it and for its DNS configuration.

12. Gamecart's property and your license

The Service, including its software, dashboard, official themes, documentation and the Gamecart name and logo, belongs to Gamecart. While these Terms are in effect, we grant you a limited, non-exclusive, non-transferable and revocable license to use the Service to run your stores.

  • You may customize and copy an official theme to use it in your own stores on Gamecart, but not to distribute or resell it.
  • You may not copy, reverse engineer or resell the Service, or use it to build a competing product, except as the law expressly allows.
  • Components we publish under an open-source license, such as our server plugins, are governed by that license.
  • You may not use the Gamecart name or logo in a way that suggests a partnership or endorsement we have not agreed to.
  • If you send us suggestions or feedback about the Service, we may use them without any obligation to you.

13. Integrations, plugins and API

When a store delivers products by running commands on game servers, it runs the commands you configure on servers you control. You are responsible for those commands and for the security of your servers. A command may run more than once, for example after a delivery failure or when you resend a delivery, so design commands that tolerate repetition.

The API and webhooks may be used only within the permissions you grant and the limits of your plan. Third-party services you connect, such as payment providers, Discord or platforms you import data from, are governed by their own terms, and Gamecart is not responsible for them.

14. Availability and changes to the Service

We make reasonable efforts to keep the Service available, but we do not offer a service level agreement and do not give credits or compensation for downtime. The Service may be unavailable during maintenance, updates or failures of the providers it depends on.

We continuously develop the Service and may add, change or remove features. If we remove a material feature of the plan you subscribe to, we will notify you in advance, and you may cancel before the change applies to you.

15. Suspension and termination

You may stop using the Service at any time and ask us to close your account at support@gamecart.gg.

We may restrict, suspend or terminate a store or an account if:

  • you breach these Terms or the Acceptable Use Policy;
  • the store receives an unusually high volume of disputes, chargebacks or buyer complaints;
  • we are required to by law, by an order of a competent authority or by a payment provider;
  • you do not provide the identity information we request as described in Your account and security;
  • your use puts the Service, buyers, other sellers or children and adolescents at risk.

We will notify you when reasonably possible and lawful. A suspended store is taken offline to buyers. When possible, you will be able to export your data before the account is closed. Fees already paid are not refunded when a store or account is suspended or terminated because of your breach, except where the law requires it.

16. Disclaimers

The Service is provided "as is" and "as available". To the extent permitted by law, Gamecart does not guarantee that the Service will be uninterrupted or error-free, and makes no warranty about the results of your sales or about third-party services you connect.

17. Limitation of liability

To the extent permitted by law, Gamecart is not liable for indirect or consequential damages, lost profits, lost sales or lost data. Gamecart's total liability for any claim related to the Service is limited to the amount you paid Gamecart in the 12 months before the event that gave rise to it. Nothing in these Terms limits liability or consumer rights that cannot be limited or waived under applicable law.

18. Indemnification

You will defend and indemnify Gamecart against claims by buyers, rights holders, payment providers or authorities arising from your store, your products, your content or your breach of these Terms, except to the extent the claim results from Gamecart's breach of the Data Processing Addendum or of data protection law.

19. Events beyond our control

Neither party is responsible for a failure or delay caused by events beyond its reasonable control, such as attacks on the network, failures of internet, hosting or payment providers, natural disasters, epidemics, changes in law or acts of public authorities. This does not excuse your obligation to pay fees already due.

20. Changes to these Terms

We may update these Terms. For material changes we will notify you by email or in the Service at least 30 days before they take effect, and you may cancel before that date. Continued use after the effective date means you accept the new Terms. Changes that are not material take effect when published. The effective date and version at the top of this page identify the current Terms.

21. General provisions

  • These Terms, the Acceptable Use Policy and the Data Processing Addendum are the entire agreement between you and Gamecart about the Service.
  • If a provision is found invalid or unenforceable, the rest of these Terms remains in effect.
  • If we do not enforce a provision at a given moment, we do not waive our right to enforce it later.
  • We send notices to the email address of your account or in the Service. You send notices to us by email.
  • You may not transfer your account or these Terms without our written consent. Gamecart may transfer these Terms, and the accounts and data under them, to a company that succeeds it in operating the Service, such as a company formed to run Gamecart; we will notify you, and your rights under these Terms stay the same.

22. Governing law and venue

These Terms are governed by the laws of the Federative Republic of Brazil. The courts of Palmas, Tocantins, Brazil have jurisdiction over any dispute, without prejudice to any venue that consumer law guarantees you. These Terms are published only in English, and this English version is the only official version.
